Cookie Consent Implementation: Doing It Right Without Breaking Analytics
Cookie consent banners get implemented in two common ways, both flawed: a banner that's purely decorative and doesn't actually block anything until consent is given, or a banner so aggressively implemented that it breaks the analytics and functionality a business actually needs to run properly.
Why the decorative version is a real compliance risk
A banner that says "we use cookies" with an "OK" button, while tracking scripts load regardless of the answer, isn't meaningful consent under most privacy regulations — it's the appearance of compliance without the substance, which is arguably a worse position than having no banner at all.
What a properly implemented consent flow actually requires
- Non-essential scripts genuinely blocked until consent is given, not just visually hidden while still running in the background.
- A real, easy way to decline, presented with the same visual weight as the accept option, not buried behind an extra click.
- Granular categories where relevant — analytics, marketing, essential — rather than a single all-or-nothing toggle that overstates what's actually happening.
- Consent choices actually respected consistently across the site, not just on the page where the banner first appeared.
How to do this without losing your analytics entirely
Server-side or cookieless analytics options exist specifically for this — capturing aggregate usage trends without relying on the personally identifiable tracking that requires explicit consent, which keeps SEO and traffic insight reasonably intact even from visitors who decline.
A consent banner that doesn't actually control anything isn't privacy compliance. It's a UI element pretending to be one.
This is worth implementing properly the first time, in the same spirit as the broader privacy basics every modern site needs — retrofitting real consent logic after a superficial banner is already live is messier than building it correctly from the start.
